Our role as your attorneys is to prove fault and damages, and to represent you vigorously by seeking to prove each and every aspect of your case. We seek to prove these matters to those responsible for your injuries and their insurance companies and lawyers early in the course of your case so that meaningful settlement negotiations can occur. By demonstrating fault and liability, our goal is to obtain for you a fair settlement early in the process.
Typically, defendants are not willing to settle for a fair amount at the outset of a claim. Instead, they usually seek to avoid liability by placing blame on the victim, other potential defendants, or some cause other than their own actions.
How We Work Towards Achieving an Early Settlement for Clients
In representing clients, part of our job is to demonstrate to insurance companies and their lawyers that (i) their client (the defendant) is legally liable for the damages and injuries sustained by our client, (ii) their defenses are not likely to be accepted by a jury, and (iii) that they stand to lose significantly more at trial (including additional legal fees) than they are by offering a fair settlement. Only when they are convinced of these three aspects are they likely to engage in meaningful settlement negotiations.
If an Acceptable Settlement Cannot Be Reached, We Are Ready to Prove Our Clients Case at Trial
Sometimes, the defendants and insurance companies are not willing to settle a case prior to trial. They may believe they will win the trial, or they may have other reasons for not entering into a settlement.
If this is the case, we work hard and are ready to prove the case of our clients at trial. Our firm has substantial trial experience, and we have achieved many successful verdicts for our clients, including a verdict for $57 million for one client and many other verdicts in excess of $1 million.
